These Terms & Conditions ("Terms") govern your use of the ARC Marketing Group website and your participation in our communications programs. By using this website, booking a consultation, or opting in to our text messaging program, you agree to these Terms. Services provided to clients are governed by a separate written service agreement; if there is a conflict, the service agreement controls.

1. Our Services

ARC Marketing Group provides AI-powered growth systems for local service businesses, which may include website design and management, AI phone answering and appointment booking, missed-call text-back, review generation and management, and related automation services. Specific deliverables, pricing, and timelines are defined in each client's service agreement.

2. Consultations & Scheduling

Booking a consultation through our website is free and carries no obligation. We use third-party scheduling tools to manage appointments; your use of those tools is also subject to their own terms and privacy policies.

3. Text Messaging (SMS) Terms

By providing your phone number and opting in, you consent to receive informational and marketing text messages from ARC Marketing Group at the number provided, including messages sent using automated technology. Consent is not a condition of purchase.

4. Payments & Billing

Client services are billed according to the plan and payment schedule in the applicable service agreement. Payments are processed by third-party payment processors. Unless otherwise stated in writing, fees are due in advance of each service period.

5. Satisfaction Guarantee

Where offered, our 30-day guarantee applies to a client's first 30 days of service under an active service agreement. To claim the guarantee, notify us in writing within the 30-day period. The guarantee covers our service fees and does not cover third-party costs incurred on your behalf (such as ad spend, phone numbers, or software fees). Details may be further described in your service agreement.

6. Acceptable Use

You agree not to misuse this website or our communication channels, including by sending unlawful, abusive, or fraudulent content, attempting to disrupt or gain unauthorized access to our systems, or using our services in violation of applicable law.

7. Intellectual Property

The content on this website — including text, graphics, logos, and design — is owned by or licensed to ARC Marketing Group and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute it without our prior written consent. Ownership of work product created for clients is addressed in the applicable service agreement.

8. Disclaimers

This website and its content are provided "as is" without warranties of any kind, express or implied. While we work hard to deliver results, marketing outcomes depend on many factors outside our control, and we do not guarantee any specific level of calls, bookings, reviews, rankings, or revenue except as expressly stated in a written agreement.

9. Limitation of Liability

To the fullest extent permitted by law, ARC Marketing Group will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or related to your use of this website or our services. Our total liability for any claim will not exceed the amount you paid us for the service giving rise to the claim in the three (3) months preceding the claim.

10. Third-Party Services

Our website and services integrate with third-party platforms (such as scheduling, payment, calendar, and messaging providers). We are not responsible for the availability, accuracy, or practices of third-party services, and your use of them is governed by their own terms.

11. Governing Law

These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Pulaski County, Arkansas.

12. Changes to These Terms

We may update these Terms from time to time. The "Effective date" above reflects the latest revision. Continued use of the website after changes means you accept the updated Terms.
